Real Estate Agencies and Industry Bodies

 

There are a number of key regulatory bodies and industry bodies that are relevant to real estate practice in each state. 

 

Regulatory Agencies

  • Office of Fair Trading (QLD)

The Role of the Office of Fair Trading (QLD) is to regulate the Real Estate Industry in their
respective states. The Office of Fair Trading (OFT) control over agents is absolute
and is dictated by the state-specific legislation Property Occupations Act 2014 (QLD).

  • NSW Fair Trading (NSW)

The NSW Fair Trading has control over agents is absolute and is dictated by the state-specific legislation Property and Stock Agents Act 2002 (NSW)

  • Consumer Affairs (VIC)

Consumer Affairs (CA) control over agents is absolute and is dictated by the state specific legislation Estate Agents Act 1980 (VIC).

  • Consumer Protection (WA)

The Department of Mines, Industry Regulation and Safety’s control over agents are absolute
and is dictated by the state-specific legislation Real Estate Business Agents Act 1987 (WA).

Civil and Administrative Tribunal 

  • QCAT

The QLD Civil and Administrative Tribunal (QCAT) is established under the Queensland
Civil and Administrative Tribunal Act 2009. Civil and Administrative Tribunals deal with a broad and diverse range of matters, from tenancy issues and building works to decisions on guardianship and administrative review of government decisions.

  • NCAT

The NSW Civil and Administrative Tribunal (NCAT) is established under the Civil and
Administrative Tribunal Act 2013.

  • VCAT 

The VIC Civil and Administrative Tribunal (VCAT) is established under the Victorian Civil
and Administrative Tribunal Act 1998.

  • SAT 

The State Administrative Tribunal (SAT) is established under the State Administrative Tribunal Act 2004 (WA). SAT is an independent body that makes and reviews a range of administrative decisions. These range from reviews of multi-million dollar tax judgments and dog destruction orders to disciplinary proceedings, guardianship questions and town planning and compensation issues.

Industry Bodies

The Real Estate Institute in each state is the peak industry body for real estate agents and property professionals. The largest and most influential association of its kind, the industry
the body represents thousands of agents across the state.

Property Council of Australia (PCA)


The Property Council of Australia represents owners and managers of commercial, industrial
